Terms and Conditions

1. Scope of Agreement

These Terms and Conditions apply to all purchases, registrations, digital downloads, memberships, paid-access programs, and subscriptions completed through pages operated by Kimberly Helm, LLC (doing business as The Gluten Free Quilter) ("Company," "we," or "us"). By completing a transaction or checking the agreement box on our landing or checkout pages, you agree to be bound by these terms.

2. Services, Digital Products, Memberships & Subscriptions

Swap Coordination Services: Registration fees for mini swaps cover administrative labor, partner matching, and timeline management provided by Kimberly Helm, LLC. We act solely as a coordinator and facilitator, not as a merchant, manufacturer, or guarantor of the physical items exchanged between participants.

Digital Patterns & Content: All digital patterns, templates, instructional guides, and downloadable files are non-refundable once access or delivery is granted. Patterns and materials are for personal, non-commercial use only. File sharing, reselling, or public distribution of digital goods without express written permission is prohibited.

Memberships & Paid-Access Programs: Kimberly Helm, LLC may offer recurring memberships as well as fixed-term paid-access programs. Pricing, billing frequency (if applicable), access period, included benefits, cancellation terms, and other program-specific terms will be disclosed at the time of purchase.

The PIECEful Beehive: The PIECEful Beehive is a fixed-term paid-access community program. The registration fee provides access for the program period stated at checkout. The PIECEful Beehive is not a recurring subscription and does not automatically renew. Registration fees are non-refundable once processed except where required by law or expressly stated otherwise in writing.

Recurring Subscriptions & Memberships: Recurring memberships, including The PIECEful Post, automatically renew according to the billing frequency disclosed at checkout unless canceled. Payments that have already been processed are final and non-refundable except where required by law or expressly stated otherwise in writing.

The PIECEful Post: The PIECEful Post is an ongoing quilting membership featuring a new January–December mystery quilt each calendar year, along with applicable membership benefits and community access.

Monthly Membership: Monthly memberships automatically renew each month on or around the member's scheduled billing date until canceled. To prevent the next recurring charge, members must cancel before their next scheduled billing date. Payments already processed are non-refundable.

Annual Membership: Annual memberships automatically renew each year on or around the member's scheduled renewal date until canceled. To prevent the next annual charge, members must cancel before their scheduled renewal date. Payments already processed are non-refundable.

Founding Paid-in-Full Membership: Special founding paid-in-full offers, when available, cover the membership period stated at checkout and do not automatically renew unless expressly stated otherwise at the time of purchase. Founding paid-in-full purchases are non-refundable once processed.

Cancellation: Members may cancel a recurring membership through the cancellation method provided with their membership or billing information. Cancellation stops future recurring charges and does not provide a refund for payments already processed. Access and benefits associated with an already-paid membership period may continue through the applicable paid period.

Kimberly Helm, LLC reserves the right to modify, discontinue, or replace a membership or subscription program. If a change materially affects an active recurring membership, applicable members will be notified in advance as required by law.

3. Mini Swap Terms & Liability Waiver

Assumption of Risk: Swaps rely on independent participant cooperation. While we make reasonable efforts to manage events effectively, Kimberly Helm, LLC is not responsible for the quality, condition, safety, or delivery delays of items sent by third-party participants, nor can we guarantee every partner will complete their exchange.

Participant Obligations: Swap participants must meet specified shipping deadlines, provide tracking information to both their partner and the organizer, and adhere to community guidelines. Failure to complete an exchange without timely notice may result in removal from future events.

4. Privacy & Data Protection

We value your privacy and do not sell or rent personal information to third-party marketers.

For Participants in Swaps, Exchanges, or Similar Programs: You authorize Kimberly Helm, LLC to share the shipping address and contact details you provide only with your assigned swap partner(s) as necessary to facilitate the exchange.

For All Customers: Your data may be used for order fulfillment, program administration, platform operations, customer service communications, and marketing communications where you have provided the applicable consent.

5. Fees & Refund Policy

Unless otherwise stated in writing at the time of purchase, payments—including swap registration fees, digital product sales, paid-access program fees, subscription charges, and membership charges—are final and non-refundable once processed, except where required by law.

6. Intellectual Property

All original patterns, instructional materials, branding, logos, graphics, and digital content created by Kimberly Helm, LLC remain our intellectual property and are protected under applicable United States intellectual property laws.

7. Limitation of Liability & Governing Law

To the fullest extent permitted by applicable law, Kimberly Helm, LLC, its owners, and agents disclaim applicable express or implied warranties and will not be liable for losses arising from circumstances outside our reasonable control, including the actions of independent swap participants or third-party delivery services.

These Terms and any dispute arising from them will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
